Welcome to Caring CourseForge. These Terms govern your access to and use of our AI-powered course creation platform, including all content, features, and services we provide. These Terms apply to all users, including free and paid subscribers.

For purposes of these Terms:

• "Service" means Caring CourseForge, including our website, platform, applications, and all related services
• "Content" means text, graphics, images, courses, lessons, quizzes, and other materials available through the Service
• "User Content" means content you create, upload, or generate using our Service
• "AI-Generated Content" means content created by our AI features based on your inputs
• "We," "Us," "Our" refers to Caring Consulting Co. LLC and Caring CourseForge
• "You," "Your" refers to the individual or entity using the Service

2.1 Eligibility

You must be at least 13 years old (or 16 in the EU) to use our Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

2.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring your account information is accurate and up-to-date

3.1 Permitted Use

You may use the Service to:

• Create, edit, and manage educational courses
• Generate course content using our AI features
• Export courses in SCORM and web formats
• Collaborate with team members (on applicable plans)
• Integrate with learning management systems

3.2 Prohibited Activities

You agree NOT to:

• Violate any applicable laws, regulations, or third-party rights
• Use the Service to create content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Infringe upon intellectual property rights of others
• Attempt to gain unauthorized access to the Service or other users' accounts
• Transmit viruses, malware, or other malicious code
• Use automated systems (bots, scrapers) without our written permission
• Resell, redistribute, or sublicense access to the Service
• Use the Service to train competing AI models or services

4.1 Your Content Rights

You retain all ownership rights to your User Content. By using the Service, you grant us a worldwide, non-exclusive license to host, store, process, and display your content as necessary to provide the Service.

4.2 AI-Generated Content

Content generated by our AI features based on your prompts is provided to you, but may not be unique. You are responsible for reviewing AI-Generated Content for accuracy and compliance with applicable laws before use.

5.1 Subscription Plans

We offer multiple subscription tiers:

• Free Plan: Up to 3 courses
• Creator Plan: $19/month - Unlimited courses
• Professional Plan: $49/month - Teams & analytics
• Enterprise Plan: Custom pricing

5.2 Billing and Payment

• Subscriptions automatically renew unless cancelled
• All payments are processed securely through Stripe
• We offer a 14-day money-back guarantee for new subscribers
• After 14 days, subscriptions are non-refundable

5.3 Stripe Climate Contribution

1% of all revenue from subscriptions is contributed to Stripe Climate for carbon removal and climate change mitigation efforts.

You acknowledge and agree that:

• No guarantee of accuracy: AI-Generated Content may contain errors or inaccuracies
• Your responsibility: You must review and verify AI-Generated Content before use
• No liability: We are not responsible for any consequences arising from your use of AI-Generated Content
• Training data opt-out: Your prompts and content are not used to train AI models

7. LIMITATION OF LIABILITY

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

8. Termination

You may cancel your subscription at any time. We may suspend or terminate your account if you violate these Terms. Upon termination:

• Your access to the Service will be immediately revoked
• Your User Content will be deleted after a 90-day grace period
• No refunds will be provided for partial billing periods

9. Dispute Resolution

These Terms are governed by the laws of the State of California. Before filing any formal legal action, please contact us to seek an informal resolution.

Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING.
